Terms of service agreement

RSDK Web Solutions Hosting, for customers using website hosting, website development or other services provided by RSDK Web Solutions Web Design

The following are the terms of services for website hosting, domain registration and website development services provided by RSDK Web Solutions Hosting, (“RSDK Digital Solutions)”. Customer will provide the required billing address and any other information for RSDK Web Solutions to maintain website hosting and registration services. Any information not provided at sign-up will be provided by RSDK Web Solutions Web Design and Customer. Signing our order form, or submitting an online order for the service, indicates a contract for these terms of service.

1. Website Hosting Payment Terms:

Billing for the website hosting service will begin when the website hosting service is created, prior to the development of a new website project. Website hosting services are invoiced monthly. Payment is due on the 15th of the current month’s hosting service. Termination of website hosting services with RSDK Web Solutions requires 30-day advance notification via phone, e-mail or postal mail. If a customer chooses to activate their domain name through RSDK Web Solutions, their domain name registration will end with their hosting service. RSDK Web Solutions reserves the right to change rates by notifying customers 60 days before the effective date of change. RSDK Web Solutions reserves the right to cancel the hosting service at any time.

2. Website Hosting Pre-Payment Terms:

RSDK Web Solutions can offer an exemption to pay a full one year of hosting service. Refunds will not be issued in the case that a customer cancels their hosting service before the period for which they have pre-paid.

3. Payment Terms Website Development:

A. Custom Website Development:

RSDK Web Solutions requires a minimum 50% down payment on all custom website development and design services. The down payment on website development is non-refundable, and the down payment amount can be modified at the RSDK web solution discretion. The website development project has a final balance of 15 days from completion. If RSDK Web Solutions is developing a website that is not hosted by RSDK Web Solutions, the final payment for the project must be received before the project launch or the customer must renounce ownership. Should a development project exceed 30 days, the client will receive progress billing in the amount of at least 25% of the remaining balance each month, which begins on the 30th day of development. Maintenance and updates to the website are billed on 1 calendar day of the following month.

B. Semi-Custom Website Development:

RSDK Web Solutions requires the first month for semi-custom website subscription services, and full payment for any add-on, prior to order completion and development. As long as the service remains active, monthly service will be billed on the first day of each calendar month.

4. General Payment Terms:

Payment is 15 days after the invoice date for all services. Accounts are in default if payment is not received 20 days after the invoice date. If the customer pays by check that is not clear, the customer is immediately in default and subject to a returned check charge of $ 35. Unpaid accounts will be subject to service interruption 60 days after the invoice date. This type of interruption does not relieve you from the obligation to pay the monthly fee. Accounts of default are subject to an interest charge of $ 5.00 or 1.5% per month on the outstanding balance, whichever is greater. If your state law does not allow an interest rate of 1.5% per month, then the maximum allowable rate for your state will be charged. If you default, you agree to pay RSDK Web Solutions its reasonable expenses, including attorney and collection agency fees, in enforcing its rights under these terms and conditions.

5. Content Responsibilities:

The customer is responsible for all content posted or stored at their web hosting location. RSDK does not have any control over the content or information contained on the server used for hosting web solutions. RSDK Web Solutions will not be responsible for any direct, indirect or consequential loss that may result from the use of this service by its customers or any other related or unrelated third party. RSDK Web Solutions is not responsible for backing up data or recovering data in case of loss on behalf of the customer. There are no express or implied warranties as to the software provided by RSDK Web Solutions or used by the customer.

6. Service Interruption:

RSDK Web Solutions is not responsible for service disruptions beyond its control. This includes interruptions to its suppliers and natural disasters.

7. Account credentials:

Customer agrees to keep all user IDs and access codes / passwords confidential. Sharing account information and passwords is strictly prohibited. If a customer believes that his user ID or password has been compromised, the customer agrees to contact RSDK Web Solutions immediately via e-mail or telephone.

8. Governing Law:

The corporate office of RSDK Web Solutions Web Design is located in Mumbai, Maharashtra, India. This agreement will be governed by and in accordance with the laws of the State of Minnesota. Any claim or legal action arising out of this service agreement must be initiated within one year after the claim or cause arises. RSDK Web Solutions reserves the right to discontinue service for violation of any of the terms of this service agreement.

All claims, disputes and disputes arising out of or in connection with the performance, interpretation, application or enforcement of this Agreement are included but are not limited to arbitration only, and as a condition precedent to it, Initiation of any ancillary action or proceeding, including arbitration.

9. Third Party Network:

Any access to other networks connected to the network of RSDK Web Solutions Web Design must follow the rules appropriate to that other network.

10. Disk Storage and Bandwidth:

RSDK Web Solutions Web Design will monitor the customer’s current disk storage and bandwidth. If the amount registered for use exceeds, RSDK Web Solutions will contact the customer in an effort to arrange additional resources. If the customer does not respond, or is unable to reach, RSDK Web Solutions will have the authority to take corrective action for more than the resources. Such actions may include assessing additional fees, extending the service plan, temporarily discontinuing services, or terminating the current agreement. If the customer feels that more disk storage is needed, it is the customer’s responsibility to contact RSDK Web Solutions Web Design (info@rsdkwebsolutions.com or +919140552177) to discuss options for increased disk storage.

11. Content and Terms of Use:

All services provided by RSDK Web Solutions Web Design can only be used in accordance with the law. The collection, documentation, transmission, or presentation of information or data that violates US federal, state, or city law is strictly prohibited. This includes, but is not limited to copyright or literary material, racist or threatening material, pornography, pornography, “adult only” content, or material protected by other law.

RSDK Web Solutions prohibits web design website hosting customers from participating in pirating unlisted software, pirating MP3 files, listing hacker programs or archives, hosting ware websites, pornography. Customer agrees to indemnify and retain the design of RSDK Web Solutions Web Design, which is harmless from any claim arising from the use of the services of RSDK Web Solutions Web Design that harms the Customer or any other party. RSDK Web Solutions Web Design’s use of web hosting and e-mail services to send unsolicited commercial e-mail (UCE or “SPAM”) is strictly prohibited and may cause immediate account termination. The customer agrees to pay RSDK Web Solutions any reasonable expenses, including attorney and system administration fees, in response to complaints and damages arising from the action of sending unsolicited commercial e-mail.

12. Proposal compliance:

It is the responsibility of the customer to review all proposals for website development, website design and other services provided by RSDK Web Solutions. Should services or resources be above the scope of the original offer, RSDK Web Solutions reserves the right to appropriately reject project add-ons or invoices for additional time and required content. At the discretion of RSDK Web Solutions, payments that fall above the scope of the original project are to be developed or netted 15 days in advance.

13. Project Timeline:

It is the responsibility of the customer to review the project timeline and follow the dates for delivery of their parts. Failure to meet the deadline imposed by RSDK Web Solutions will result in the project being delayed, or the project being put on hold. RSDK Web Solutions can invoice the customer for additional resources, causing project interruptions to delay the workflow of RSDK Web Solutions. Indeterminate delays of a project can lead to project termination, and a new development agreement must be reached before the project can be resumed. The down payment for services is non-refundable, and should not be returned to the customer, as the project must be delayed or terminated due to failure to follow the project timeline.

14. Administrative Access:

To prevent malware installations on our servers, customers will not be given full administrative access to the WordPress installation on the hosting services of RSDK Web Solutions. Customers can request access to specific features of a website, and access can be granted at the discretion of RSDK Web Solutions.

15. Website Copyright:

A. Custom website:

After receipt of full payment for the website, the copyright on the custom website is transferred to the website buyer. If the copyright transfer process is in place, the customer can get a full backup of their website upon cancellation. This backup will contain the entire file structure in the .zip file and if applicable, the SQL file consists of a MySQL database dump.

B. Semi-custom website:

WordPress login credentials are not available for customers purchasing a membership or layout website. Copyright on semi-custom website development is transferred to the website buyer after one (1) year of active subscription service. If a semi-custom website is paid in advance, the copyright is transferred to full payment for the development of the website. If the copyright transfer process is in place, the customer can get a full backup of their website upon cancellation. This backup will contain the entire file structure in the .zip file and if applicable, the SQL file consists of a MySQL database dump.

16. Website Go Live and Access:

A project is considered complete when full development scope has been reached, and the project is approved by the client. Should the client request changes beyond the consent in the original proposal, RSDK Web Solutions can complete these changes at an additional cost. After the completion of a project, the customer has a business week to launch the website, or provides RSDK Web Solutions with the credentials needed to bring the website live. Failure to launch a website within a week of project completion can lead to a delay in live dates, and additional costs at the discretion of RSDK Web Solutions. After a project is completed, all changes requested will fall under the standard website maintenance schedule of RSDK Web Solutions. Account access to the website and written or oral training, as agreed in the initial proposal, will be made only after the final payment for the project is received by RSDK Web Solutions.

17. Termination / Cancellation Policy:

RSDK Web Solutions web design requires 30 days notice before cancellation of website hosting account. For business website solutions, where the cost of development is broken down into monthly payments rather than an upfront development fee, a minimum contract of one year is required. If the service is canceled early, the final balance is payable in the remaining months of service. Two years of continuous service must be paid for copyright releases, or to obtain a copy of their website files or administrative logins. Upon cancellation, you will be billed with your final balance (up to 30 days after notification) after your canceled request. At the time of cancellation, all website files, email accounts and e-mails will be removed from our servers; You are responsible for requesting the backup of these files should you require them for future use.
